Pornhub Risks Losing Its Domain Name in Bizarre Piracy Lawsuit

Pornhub sister company MG Premium is embroiled in a lawsuit that puts the pornhub.com domain at risk. The company, which is part of the MindGeek imperium, sued the tube site Goodporn for massive copyright infringement. However, Goodporn turned the tables by claiming that it owns the rights, citing a previously signed agreement that MindGeek dismisses as fraudulent.

pornhub copyrightPornhub is without a doubt one of the most visited adult entertainment outlets on the Internet.

The ‘entertainment’ platform is owned by MindGeek, the company formerly known as Manwin. In just a few years it has transformed the adult industry’s pay-to-access model into an all-you-can-eat, free-to-stream business.

Part of this magic formula is down to Pornhub and other MindGeek-owned tube sites allowing users to share content. This material includes legitimate videos from official Pornhub models, as well as thousands of videos that are copyrighted by MindGeek, such as the Brazzers and Reality Kings brands.

This content is freely available and monetized through advertisements. However, there is one particular threat to this lucrative business model: pirate sites.

When Pornhub got started fifteen years ago the site featured many pirated videos itself. Today, this image has changed, partly due to the mandatory verification of uploaders. Instead, Pornhub’s parent company MindGeek is now actively waging legal battles against competitors.

These DMCA takedown campaigns and lawsuits have already resulted in some success. Just a few months ago, MindGeek won its case against DaftSex. In addition to millions of dollars in damages, the court also ruled that the company could take over related domain names, which had millions of visitors.

DaftSex wasn’t completely defeated and soon reappeared with a new domain name. Meanwhile, MindGeek’s attention is drawn to its lawsuit against tube site Goodporn, which had some bizarre developments recently.

MindGeek Sues Goodporn

Initially filed in 2021 at a federal court in California, the copyright infringement lawsuit accuses the site and its operator of large-scale copyright infringement.

“The GoodPorn Website is a pirate website, displaying copyrighted adult entertainment content without authorization or license,” the complaint alleged.

MindGeek initially tried to contain the problem by sending DMCA takedown notices. This didn’t help, as the site purportedly ignored them, allowing it to profit from the alleged infringing activity of its users.

“Defendants do not even attempt to comply with their obligations under the DMCA. Instead, Defendants systematically refuse to comply with proper and compliant DMCA takedown notices,” MindGeek wrote.

The complaint is similar to those seen earlier targeting alleged pirate sites. The response is altogether different, however. Goodporn’s owner, Amrit Kumar from India, is fighting back hard.

‘Pro Se’ Defense & Attack

Kumar has answered the complaint with “pro se” filings, which means that he is representing himself without a lawyer. This is unusual but not noticeable from the text. The arguments read as if they were written by an attorney or even a team of lawyers.

After failing to have the case dismissed over a lack of jurisdiction, the defendant submitted an answer to the complaint which denies all copyright infringement allegations in addition to a counterclaim.

The counterclaims and defense go hand in hand. They are predicated on the claim that MindGeek (MG Premium) signed a bilateral agreement with Goodporn in 2019, to transfer the rights of its content.

A copy of the agreement is offered as evidence and signed by Kumar. MindGeek’s Ferass Antoon is listed as the second signatory. Antoon was the CEO of the adult company but left his position a few months ago, according to media reports.

Fraudulent Agreement?

Kumar brought this agreement up at an earlier stage of the lawsuit since it suggests that the site had the right to use the contested videos. In response, MindGeek subsidiary MG Premium dismissed the document as fraudulent.

“Defendant Kumar has made a claim of ownership of Plaintiff’s work and infringement by Plaintiff. First, he claims ownership over all of Plaintiff’s works via a contract that is, on information and belief, fraudulent.

“The alleged signatory for Plaintiff, Feras Antoon, has never held any position with Plaintiff,” MG Premium added.

The latter sentence may refer to the fact that MindGeek is not the same company as MG Premium. The latter is a subsidiary, under which thousands of MindGeek-linked copyrights are registered.

Whether the document is real or not remains a point of contention and it’s not our place to opine on that. The matter will eventually have to be resolved in court but the counterclaim suggests more fireworks may lie ahead.

Goodporn accuses MG Premium of unfair business practices and breach of contract. The first claim partly relates to DMCA notices MG Premium sent to Google, asking it to remove Goodporn URLs. The notices were illegitimate, Kumar argues.

The breach of contract claim alleges that MG Premium is the copyright-infringing party here, as the company signed over its rights to Goodporn.

“Counter Plaintiff entered into a bilateral agreement with Counter defendant, MG Premium Ltd, under which all the counter defendant’s contents, including videos, galleries, and stories, were transferred to Counter Plaintiff. Counter Defendant is currently violating counter Plaintiffs copyrights by continuing to use these works without permission.”

Kumar adds that the agreement is legitimate and suggests that there is a financial paper trail to back this up.

“The bilateral agreement is real and legitimate. The contract’s validity can be confirmed by checking Mr. Feras Antoon’s financial statements or those of his partners, such as Bernd Bergmair, who owns a majority of Mind Geek, and David Tassillo, the COO of the company.”

The court will ultimately have to make sense of this bizarre situation. Kumar’s demands show that there is a lot at stake, including Pornhub’s future.

As part of the counterclaim, Goodporn requests $10 million in damages for breach of contract, as stipulated in the agreement. In addition, Goodporn wants to be on record as the legitimate rightsholder, while MG Premium should stop all infringing activities.

The Pornhub.com domain name is also at risk, as Goodporn asks the court to sign it over if it wins the case.

The counterclaim further requests an order that requires Google to reinstate all Goodporn URLs that were removed based on MG Premium’s DMCA notices, while credit card businesses should be ordered to stop working with allegedly infringing sites such as Brazzers.com and Mofos.com.

Needless to say, the allegations from both sides must be proven before damages or other relief come into play. Thus far, the adult entertainment imperium doesn’t seem to be particularly concerned.

“These counterclaims are untrue, frivolous, and absurd. We look forward to our attorneys dealing with this matter through the court system,” MindGeek informs TorrentFreak.

Apple’s focus on secrecy violated employee rights, US regulators find

Ex-employees complained to NLRB about Apple rules and a Tim Cook email.

Apple violated US labor laws through various workplace rules and statements made by executives, National Labor Relations Board officials determined after reviewing allegations from two former employees. An NLRB official will file a formal complaint against Apple unless the company reaches a settlement with the former employees, who filed complaints about Apple's focus on secrecy.

An NLRB spokesperson confirmed to Ars today that the labor board's regional office "found merit to four charges alleging that various work rules, handbook rules, and confidentiality rules at Apple violated Section 8(a)(1) of the National Labor Relations Act because they reasonably tend to interfere with, restrain, or coerce employees in the exercise of their right to protected concerted activity."

The regional office additionally "found merit to a charge alleging statements and conduct by Apple—including high-level executives—also violated the National Labor Relations Act," the NLRB statement said. That's apparently a reference to an email in which Apple CEO Tim Cook warned staff not to leak confidential information.

No more export licenses: US plans to fully cut off Huawei from chip suppliers

Huawei has been hobbling along for a few years now with limited access to US chips and technology, with both the Trump and Biden administrations banning general exports to the company. Huawei hasn't seen zero US chips, but every sale has had to be approved by the government, with the restrictions being tweaked several times since the initial ban in 2019. Reuters, The Financial Times, and several other outlets have reported that the Biden administration is putting even tighter restrictions on Huawei, with FT saying the US is working toward a "total ban" on sales to the Chinese tech company.

Like every tech company, Huawei buys components from a bunch of different suppliers to make its network equipment and smartphones. While a ton of manufacturing is done in China, there aren't many options for CPUs, and US companies Qualcomm and Intel have been keeping Huawei afloat with limited government-granted export licenses. Intel chips have meant the company can still build servers, and while 5G tech was banned from export, Qualcomm went out of its way to make special, 4G-only versions of its latest SoCs.

As the US tried to balance hurting Huawei without hurting US suppliers that have Huawei as a customer, the decision was made to still allow sales, just not of the latest technology. The cutoff point for this was the always-nebulous moniker of "5G," but now even that is being shut off. Reuters says: "U.S. officials are creating a new formal policy of denial for shipping items to Huawei that would include items below the 5G level, including 4G items, Wifi 6 and 7, artificial intelligence, and high-performance computing and cloud items." It sounds like that would ban all sales from Intel and Qualcomm.

Americans spend an exorbitant amount of money on health care and have for years. As a country, the US spends more on health care than any other high-income country in the world—on the basis of both per-person costs and a share of gross domestic product. Yet, you wouldn't know it from looking at major health metrics in years past; the US has relatively abysmal health. And, if anything, the COVID-19 pandemic only exacerbated the US health care system's failures relative to its peers, according to a new analysis by the Commonwealth Fund.

Compared with other high-income peers, the US has the shortest life expectancy at birth, the highest rate of avoidable deaths, the highest rate of newborn deaths, the highest rate of maternal deaths, the highest rate of adults with multiple chronic conditions, and the highest rate of obesity, the new analysis found.

"Americans are living shorter, less healthy lives because our health system is not working as well as it could be," Munira Gunja, lead author of the analysis and a senior researcher for The Commonwealth Fund’s International Program in Health Policy and Practice Innovation, said in a press statement. "To catch up with other high-income countries, the administration and Congress would have to expand access to health care, act aggressively to control costs, and invest in health equity and social services we know can lead to a healthier population."

How to tell if your cats are playing or fighting—and whether it’s a problem

Reciprocity is the key. And occasional squabbles don’t mean your cats hate each other.

Anyone with more than one cat in the house knows that the occasional spat or outright cat fight is going to happen. But sometimes it can be tricky to determine whether cats are fighting or just playing rough, because the interaction could feature trademark behaviors of both, according to a recent paper published in the journal Scientific Reports. It's even more challenging to tell whether the fight is just a squabble or a sign that the cats simply can't get along, thereby forcing hard decisions about how to separate the cats—or even whether it's possible to keep the cat(s) in question.

In 2021, co-author Noema Gajdoš‑Kmecová, a veterinarian with the University of Veterinary Medicine and Pharmacy in Košice, Slovakia, and several colleagues published a review paper proposing the development of a common terminology and more of a "psychobiological" approach to the study of cat behavior—particularly when it comes to play behavior. Past studies had focused on a cat's play activity, such as whether it was playing with a toy or another cat. But such observation yields little insight into the function of such play and, by extension, a cat's motives or emotional state.

"When one cat treats another as an object or prey, such activity relates to the former cat seeking to learn about its own skills in relation to manipulating its physical environment (prey are not considered part of the complex social relationships and thus social environment of an individual)," they wrote in that paper. "However, when interaction between cats is reciprocal it may function to facilitate social learning and may be best described as mutual social play." Because such interactions are dynamic, they argued that any functional classification system must be flexible enough to account for such nuances.

Since 2016, social workers in a Pennsylvania county have relied on an algorithm to help them determine which child welfare calls warrant further investigation. Now, the Justice Department is reportedly scrutinizing the controversial family-screening tool over concerns that using the algorithm may be violating the Americans with Disabilities Act by allegedly discriminating against families with disabilities, The Associated Press reported, including families with mental health issues.

Three anonymous sources broke their confidentiality agreements with the Justice Department, confirming to AP that civil rights attorneys have been fielding complaints since last fall and have grown increasingly concerned about alleged biases built into the Allegheny County Family Screening Tool. While the full scope of the Justice Department’s alleged scrutiny is currently unknown, the Civil Rights Division is seemingly interested in learning more about how using the data-driven tool could potentially be hardening historical systemic biases against people with disabilities.

The county describes its predictive risk modeling tool as a preferred resource to reduce human error for social workers benefiting from the algorithm’s rapid analysis of “hundreds of data elements for each person involved in an allegation of child maltreatment.” That includes “data points tied to disabilities in children, parents, and other members of local households,” Allegheny County told AP. Those data points contribute to an overall risk score that helps determine if a child should be removed from their home.
