First US death linked to monkeypox reported in immunocompromised adult in Texas

Officials are still determining the exact cause of death, which occurred August 28.

A severely immunocompromised adult who tested positive for monkeypox has died in Texas, marking the first US death connected to the global outbreak, state health officials said Tuesday.

Such deaths have been a rarity in the public health emergency. While the global case count is nearing 49,000, the World Health Organization has only recorded 15 monkeypox-related deaths. In the US, the Centers for Disease Control and Prevention have tallied 18,101 cases as of August 29. The death in Texas is the first linked to the cases.

For now, health officials are not yet sure if monkeypox was the cause of the person's death. The adult died on August 28 in Harris County, which includes Houston. Harris County officials said in a news release that an autopsy is in process, and the results will be released in the next few weeks.

Paramount Uses Copyright Claims Board to Protect Coming to America’s “Big Mick” Burger

Paramount has filed a copyright infringement claim against a company that opened a “McDowell’s”, inspired by the Coming to America movie. The pop-up restaurant, which sold the famous “Big Mick,” misled the public and sold burgers of questionable quality, Paramount notes. The case is being handled by the recently launched Copyright Claims Board.

Through this venue, hosted at the US Copyright Office, rightsholders can try to recoup alleged damages outside the federal court system.

Just over a hundred cases have been filed thus far, mostly by smaller independent creators, but some large companies have found their way to the board as well.

McDowell’s Copyright Troubles

Late last week, Paramount Pictures filed a claim against JMC Pop Ups, which is known for its pop-up restaurants carrying movie or TV show themes. This includes a McDowell’s, modeled after the restaurant prominently featured in “Coming to America.”

In the movie, McDowell’s ran into copyright issues due to its similarities with the multi-billion dollar McDonald’s franchise. In this case, however, Paramount Pictures wants to protect the McDowell’s brand against an external threat.

According to the claim, the restaurant copied a wide variety of copyrighted materials without permission.

“In creating and marketing the Infringing Restaurant, JMC copied countless copyrighted materials from the works, including but not limited to the menu, the character names and likenesses, and the recreations of well-known McDowell’s restaurant from the Coming to America universe.

“Specifically, the Infringing Restaurant’s menu used numerous well-known indicia of the Works, including the ‘Big Mick’ with a ‘non-seed bun’,” the movie studio adds in its complaint.

Advance Warnings

The legal action shouldn’t come as a surprise to JMC Pop Ups. For more than a year, Paramount’s lawyers have repeatedly reached out to the company, asking it to cease the allegedly infringing activity.

The restaurant owners didn’t believe that they had infringed Paramount’s rights. Instead, they announced plans to open a new McDowell’s in Springfield from May 20 to June 5. That announcement was a step too far for Paramount.

After JMC failed to confirm that the event would be canceled, Paramount decided to take the matter to the Copyright Claims Board. The choice of venue shows that the movie studio is mostly concerned about stopping the infringements, as available damages are limited.

Paramount notes that the pop-up McDowell’s misleads the public, who may think that it’s an official Hollywood-backed venture, which it isn’t. This is all the more problematic because the food isn’t that great, according to some reviewers.

Food Discomfort?

“JMC misused Paramount Pictures’ intellectual property to deceive parents and children into believing that the Infringing Restaurant is affiliated with, or authorized by, Paramount Pictures.”

“To make matters worse, the quality of the food is in serious question, as consumers have reported feeling discomfort after eating at the Infringing Restaurant,” Paramount Pictures adds.

Through the Copyright Claims Coard, the movie studio requests an award of $30,000 in statutory damages, the maximum available. In addition, it hopes to prevent any further infringements.

‘Creative Celebration’

Attorney John Powell, who represents the restaurant, still believes that McDowell’s didn’t infringe on Paramount’s copyrights and trademarks.

“The McDowell’s pop-up was a creative celebration of a fake restaurant,” the lawyer told the WSJ, adding that “JMC is disappointed by Paramount’s heavy-handed response to fans of its films.”

Participation in the Copyright Claims Board proceeding is not mandatory. JMC has the right to opt-out if it wishes to do so. Should that happen, Paramount can still take the matter to federal court where statutory copyright damages can reach $150,000 per work and legal fees are much higher.

Leaked Switch-esque portable from Logitech could be great for streaming, emulation

There are many Nintendo-Switch-style, Android-powered gaming handhelds out there, usually available as imports on eBay or AliExpress. Some, like the AYN Odin, are fairly well-regarded. Others, like the Retroid Pocket 2+, are less good, but they’re so cheap that they’re still worth buying for people who want a portable console for old-school game console emulators. But it's rare for any of them to have backing from a major company, reliable hardware and warranty support, or clear software update policies (beyond occasional Android version updates or support from alternate Android distributions).

That's why the rumors of a Switch-like, Android-based portable from Logitech caught our eye. Originally teased by prolific leaker Evan Blass (and preserved by The Verge following a DMCA takedown), the handheld is definitely reminiscent of a Switch Lite. It has four face buttons (arranged Xbox-style with the A on the bottom and B on the right, rather than Nintendo-style with these buttons reversed), left and right shoulder buttons and triggers, asymmetrical dual joysticks, a D-pad, and four other face buttons for various system functions. But the device appears to run a customized version of Android with full Google Play access, and it seems to have built-in access to Microsoft's, Nvidia's, and Valve's game streaming services for portable PC gaming.

Blass points out that the handheld is likely the fruit of a recently announced collaboration between Logitech and Chinese tech company Tencent. In early August, the companies said they would "combine Logitech G’s expertise in hardware with Tencent Games’ expertise in software services" to create a streaming-focused handheld gaming console at some undisclosed future date.

Portal 2 ends 9 years of Xbox 360 “Games with Gold” freebies

Starting September 16, Portal 2 will be the last Xbox 360 game made available for free to Xbox Live subscribers via the Games for Gold program.

Microsoft told subscribers in July that its monthly Games with Gold offerings "will no longer include Xbox 360 titles" starting on October 1 because "we have reached the limit of our ability to bring Xbox 360 games to the catalogue." The Games with Gold program will continue to offer free monthly Xbox One games, though, as it has since 2015.

Xbox 360 owners that subscribed to Xbox Live Gold since Games with Gold started in 2013 have gotten access to over 200 games through the program, provided they logged in to claim those games during their half-month availability window. That's not a bad value for a subscription that has remained priced at $60 per year for that entire period, despite Microsoft's recent threats to increase the price.

These self-morphing 3D wood shapes could be future of wood manufacturing

Scientists have shown how flat wooden shapes extruded by a 3D printer can be programmed to self-morph into complex 3D shapes.

Scientists from The Hebrew University of Jerusalem have created wood ink that can be extruded into flat wooden structures, self-morphing into complex 3D shapes as they dry and shrink. The researchers presented their research at last week's meeting of the American Chemical Society in Chicago. The technique could one day be used to make furniture or other wooden products that could be shipped flat to a destination and then dried to form the desired final shape.

As we've reported previously, developing novel shapeshifting materials is a very active area of research because there are so many promising applications, such as building artificial muscles—man-made materials, actuators, or similar devices that mimic the contraction, expansion, and rotation (torque) characteristics of the movement of natural muscle. The shape change comes about in response to an outside stimulus.

For instance, most artificial muscles are designed to respond to electric fields (such as electroactive polymers), changes in temperature (such as shape-memory alloys and fishing line), and changes in air pressure via pneumatics. In 2019, a team of Japanese researchers spiked a crystalline organic material with a polymer to make it more flexible, demonstrating their proof of concept by using their material to make an aluminum foil paper doll do sit-ups.
