Microsoft acquires Nuance—makers of Dragon speech rec—for $16 billion

Nuance’s deep-learning-based speech recognition serves 77% of US hospitals.

Earlier today, Microsoft announced its plans to purchase Nuance for $56 per share—23 percent above Nuance's closing price last Friday. The deal adds up to a $16 billion cash outlay and a total valuation for Nuance of about $19.7 billion, including that company's assumed debt.

Who is Nuance?

Nuance is a well-known player in the field of natural language recognition. The company's technology is the core of Apple's Siri personal assistant. Nuance also sells well-known personal speech-recognition software Dragon NaturallySpeaking, which is invaluable to many people with a wide range of physical disabilities.

Dragon NaturallySpeaking, originally released in 1997, was one of the first commercially continuous dictation products—meaning software that did not require the user to pause briefly between words. In 2000, Dragon Systems was acquired by ScanSoft, which acquired Nuance Communications in 2005 and rebranded itself as Nuance.

Charter must pay $19 million for tricking customers into switching ISPs

Charter mailed false ads to convince users Windstream was going out of business.

A judge has ordered Charter Communications to pay $19.2 million to Windstream for lying to customers in order to trick them into switching from Windstream to Charter's Spectrum Internet service. Charter also faces a $5,279 penalty for shutting off service to hundreds of Windstream's resale customers.

When Windstream filed for bankruptcy in early 2019, Charter began a "literally false and intentionally misleading advertising campaign intended to create the impression, using mailings designed to seem as if they were coming from the Debtors [Windstream], that the Debtors were going out of business," said an order issued Thursday by Judge Robert Drain of US Bankruptcy Court for the Southern District of New York.

Charter's goal with the mailings "was to induce the Debtors' customers to terminate their contracts and switch to Charter by sending them literally false and intentionally misleading information about the Debtors' bankruptcy cases and financial wherewithal," the ruling said. Charter premised its ad campaign "on false assertions regarding the Debtors' bankruptcy cases," the ruling said.

Archaeologists find “lost golden city” buried under sand for 3,400 years

A team of Egyptian archaeologists has unearthed what some describe as an industrial royal metropolis just north of modern-day Luxor, which incorporates what was once the ancient Egyptian city of Thebes (aka Waset). The archaeologists dubbed the site "the lost golden city of Luxor," and they believe it may have been devoted to manufacturing decorative artifacts, furniture, and pottery, among other items.

Hieroglyphic inscriptions found on clay caps of wine vessels at the site date the city to the reign of the 18th-dynasty pharaoh Amenhotep III (1386-1353 BCE), whose generally peaceful tenure was marked by an especially prosperous era, with Egypt at the peak of its international power. (Mud bricks at the site were also marked with Amenhotep III's cartouche.) There are more surviving statues of Amenhotep III than any other pharaoh. He was buried in the Valley of the Kings, and his mummy was discovered in 1889. Analysis revealed that Amenhotep III died between 40 and 50 years of age, and he likely suffered from various ailments in his later years (most notably arthritis, obesity, and painful abscesses in his teeth).

The pharaoh's eldest son and heir, Thutmose, died young, so the throne passed to his second son, Amenhotep IV, who soon changed his name to Akhenaten. (His queen was Nefertiti, and his son, who would eventually assume the throne, was the famous boy-king, Tutankhamun.) Akhenaten rejected the traditional polytheistic religion, dominated by the worship of Amun, and decided to start his own religion. He worshipped Aten instead (hence the name change) and would eventually try to suppress the worship of Amun entirely.

MPA Targets Pirate Streaming Sites With More Than Half a Billion Visits

Via the MPA, global anti-piracy coalition Alliance For Creativity and Entertainment is investigating several major streaming platforms. The sites, which offer mainstream movies and TV shows, are good for more than half a billion visits per year. With the help of a US court, the rightsholders are hoping to identify their operators, with disruption or even closure the ultimate aim.

MPAThe world’s major movie and TV show studios are in fierce competition, aiming to release the next blockbuster or series to capture the imaginations of the public and generate much needed revenue.

Industry counterparts are rivals in that respect but when it comes to dealing with piracy, especially when that propagates from hundreds if not thousands of unlicensed streaming platforms, teamwork is the key.

Through their global coalition, Alliance for Creativity and Entertainment (ACE), rivalries become partnerships, with resources shared to disrupt and destroy sites that dare to offer free movies and TV shows to the public.

ACE Homes in On Several Major Streaming Platforms

Investigations into pirate sites take place in the shadows, with little outward sign that a streaming platform is under investigation until it’s too late. However, there is a “canary in the coal mine” that can reveal early signs that legal or other enforcement action might not be far away.

In legal terms, the DMCA subpoena application is a straightforward and cheap-to-file legal document yet it has the power to yield crucial information when building a case against pirate site operators. Late last week ACE and the MPA went to court in the United States with such a request, one that targets several streaming platforms with well over half a billion views per year.

Cloudflare: Weak Link or Useful Proxy?

With so many pirate platforms using Cloudflare, the company has become a go-to point of contact for ACE and the MPA. An application for a DMCA subpoena filed by the groups late Friday in a California court shows that at least in theory, Cloudflare could be in a position to give up valuable information.

Listing sample infringements of movies including Almost Christmas, 47 Ronin, Varsity Blues, Forrest Gump and Flashdance, ACE and the MPA are now seeking to identify the operators of Lookmovie, Watchmovie, YesMovies, Himovies and Adfah.

Say them quickly and the domains don’t sound like they would amount to much but together they account for well over half a billion ‘pirate’ views every year.

The Targeted Domains

Lookmovie.io is by far the most popular domain on the list. From a standing start last October, the platform captured a million visits in just a month. By December, that figure had risen to just shy of 15 million.

By March 2021 the site was pulling in 18m visits per month – a potential 216 million per year – with around 30% of its traffic hailing from the United States. Interestingly, Lookmovie.io is not blocked by ISPs in the United Kingdom as similar platforms usually are, meaning that almost 14% of its traffic now comes from the region.

Lookmovie.io appears to be an alternative domain for Lookmovie.ag, a domain blocked in Australia due to legal action in 2019.

In traffic terms, Watchmovie.movie has also been on the rise. Last October the domain was good for around five million visits per month but by last month, that had risen to just short of 12.5 million, around 150 million visits per year. The domain has seen traffic increase from all major regions recently, with the United States accounting for around 19% of views.

In common with Lookmovie.io, Watchmovie.movie is doing well in the UK, where traffic share is as high as the United States after recently receiving a 35% boost. The site, which is branded on-site as WatchSeries, is not blocked by ISPs so until that situation changes, UK visitors are likely to increase.

Interestingly, data available from SimilarWeb relating to the site’s display advertising lists several ad companies but one in particular stands out. While potentially very small, Netflix.com – a prominent ACE and MPA member – is listed as a publisher.

Generating around 9.2 million visits per month, YesMovies.ag is another streaming platform being eyed by MPA and ACE for some kind of legal or enforcement action.

Its traffic has see-sawed for the past six months but in most regions traffic is on the increase, including in the United Kingdom where the site is not blocked by ISPs.

Since there have been so many sites using YesMovies branding, it’s not straightforward to link this domain to the many others previously and currently in operation. However, YesMovies domains have been targeted in numerous earlier actions, including in the United States and Australia.

The final sites listed on the MPA and ACE subpoena are HiMovies.to and Afdah.info. The former is currently enjoying around 6.25 million visits per month according to SimilarWeb, with the latter pulling in close to 6.2 million. Both are most popular in the United States but also in the United Kingdom too, where are neither are currently subjected to ISP blocking.

ACE and MPA Subpoena Demands Action From Cloudflare

“The ACE Members (via the Motion Picture Association, Inc.) are requesting issuance of the attached proposed subpoena that would order Cloudflare, Inc. to disclose the identities, including names, physical addresses, IP addresses, telephone numbers, e-mail addresses, payment information, account updates and account histories of the users operating the websites listed [above],” the DMCA subpoena application reads.

Precisely what the applicants want to do with the information is unclear at this stage but we have seen in the past that in addition to direct legal action, sites listed in DMCA subpoenas can later appear in applications for ISP blocking in the UK.

After previously demanding in a similar DMCA subpoena that Cloudflare should hand over the personal details behind several 123Movies-branded sites, the domains appeared in a High Court injunction and were subsequently blocked by the UK’s leading ISPs in February.

Over the past several years Cloudflare has been heavily criticized for allowing its services to be used by pirate sites, particularly operations such as The Pirate Bay. The argument is that the CDN service should part company with infringing sites but to date, Cloudflare has dismissed its role as that of a simple intermediary.

How long can Epic afford to throw money at the Epic Games Store?

The bitter court fight between Apple and Epic is primarily focused on the mobile-gaming landscape and Apple's iron-fisted control of the iOS App Store. But recent court filings in that case have also given the public a rare glimpse into just how much money Epic is throwing at the Epic Games Store as it struggles to make a dent in the PC marketplace.

The raw numbers, as reported in a "Proposed Findings of Fact and Conclusions of Law" document Apple filed last week, show massive incurred and projected losses for Epic's game download hub, which launched in late 2018. Documents and testimony from Epic itself show a $181 million loss for the store in 2019 and projected losses of $273 million in 2020 and $139 million in 2021.

You might think Epic is incurring those losses because it only takes a 12 percent cut of third-party game revenues, compared to the industry-standard 30 percent cut on other digital storefronts. On the contrary, though—in its own court filings, Epic says that 12 percent revenue chunk has been "sufficient to cover its costs of distribution and allow for further innovation and investment in EGS."

RIP to the Google Shopping app. XDA spotted a hidden closing message in the app on Thursday, and late Friday, Google confirmed to 9to5Google that the Shopping app is on the way out. Here's the company's statement:

Within the next few weeks, we’ll no longer be supporting the Shopping app. All of the functionality the app offered users is available on the Shopping tab. We’ll continue building features within the Shopping tab and other Google surfaces, including the Google app, that make it easy for people to discover and shop for the products they love.

The Google Shopping app launched only 19 months ago, when it took over for another Google shopping shutdown, Google Express. The Google Shopping service has been a rough proposition for users—starting in 2012, it has been nothing but an ad vector that exclusively showed "paid listings" and no organic results whatsoever. This made some sense as a service that showed advertisements in little embedded boxes in Google.com search results, but it was unclear why a user would download an app that exclusively shows ads.

In April 2020, Google Shopping gave up on the "paid listings only" policy and started listing anyone that signed up on the "Google Merchant Center." The Merchant Center has retailers generate and send Google a product data feed, which is used for the search results. This means Google Shopping still isn't a spider-driven search engine the way Google Search is. Google Search does it best to find, catalog, and index the world's data, while Google Shopping doesn't go out of its way to index the web; it only cares about businesses that send it data feeds. This can lead to woefully inadequate listings for some searches, especially for companies Google doesn't like. For instance, a search for "Amazon Echo" will never list an Amazon.com result in the Shopping search results (Amazon is welcome to buy an ad, though).
