Biden administration launches big push for offshore wind

Big cross-agency effort will set the stage for massive growth by 2050.

On Monday, the Biden administration announced a major effort to kickstart the offshore wind industry in the US. While offshore installations have been booming in Europe, the US is still limited to a single, small offshore farm, with new projects seeing repeated delays during the previous administration. Now, the US is laying the groundwork to see 30 GW of offshore capacity installed over the decade, with extensive growth possible in the decades beyond.

The effort involves the coordinated activities of multiple agencies, including everything from accelerated permitting of planned projects to research funding intended to lower future costs.

While the US is one of the global leaders in wind power, almost all of its turbines are on land. Here, the logistics of installation and needed support hardware are substantially simpler and less expensive. That's allowed wind power prices to eclipse nearly every other option for generating electricity. But offshore wind is far more challenging, and it's only recently that costs have dropped to the point where it's competitive with nuclear and coal.

California Suspended ‘Copyright Troll’ Malibu Media’s Corporate Status

California’s Franchise Tax Board has suspended the corporate status of adult entertainment company Malibu Media. The Los Angeles company, which is known for suing alleged BitTorrent pirates, failed to meet its tax obligations. In light of this development, an accused file-sharer now wants the company’s CEO Colette Pelissier to be added to a pending countersuit.

taxJust two years ago, Malibu Media was one of the most active ‘copyright trolls’ in the United States.

The Los Angeles-based company behind the ‘X-Art’ adult movies filed thousands of lawsuits targeting Internet subscribers whose accounts were allegedly used to share Malibu’s films via BitTorrent.

Then, seemingly out of nowhere, the lawsuits stopped. For more than a year there haven’t been any new John Doe complaints. In fact, the only notable case dates back to January 2020, when Malibu’s former law firm sued the company over breach of contract and unpaid bills.

This doesn’t mean that all outstanding “John Doe” cases have been resolved. At the time of writing, there are a few still pending. This includes one where Malibu Media has to defend itself against a counterclaim of abuse of process, among other things.

Malibu Media Suspended over Tax Troubles

In a recent filing, this case brought an interesting finding to the forefront. As it turns out, the California Secretary of State has suspended Malibu Media LLC’s corporate status because the company failed to meet its tax obligations.

The “John Doe” sees the suspension as a problem because, under California law, a suspended company may not prosecute or defend a legal action. That could spell trouble for the ongoing case.

Adding Malibu’s CEO to the Countersuit

To fix this issue, John Doe now asks the court if he can add Malibu Media CEO Colette Pelissier as a counter-defendant. This allows the case to be resolved, even if Malibu can’t defend itself. That is important, as Doe hopes to make the company or its CEO pay for his attorney’s fees and damages.

“Not only does Doe have a right to add a defense and counterclaim allegations based on his recent discovery about Malibu, but he also should have a chance to protect his request for attorney’s fees and damages if Malibu goes defunct.

“Joining Pelissier affords this. She has always pulled the company’s strings including in this dispute, making her a proper counterclaim defendant even at this stage,” the Doe adds.

Assets Being Transferred?

The accused file-sharer isn’t convinced that Malibu Media is able to resolve the suspension. In fact, he questions whether the company is preparing to transfer its intellectual property and other assets to then go bankrupt.

This week, Malibu Media responded in court. The company notes that its suspension is not much of an issue, accusing John Doe of wasting the court’s time.

“In essence, Defendant is using a small, technical irregularity to attempt another bite at the abuse of process apple, to multiply the proceedings unnecessarily,” the company writes.

‘Inadvertently Missed Payment’

Malibu admits that it “inadvertently” missed a California Franchise Tax Board payment. However, the company stresses that this can be resolved, after which the case should be able to continue as usual.

“A suspended corporation can revive itself […] by simply paying its back taxes and filing the appropriate paperwork. Further, once a corporation has been revived, its tax delinquencies, upon correction, are viewed as mere irregularities,” the company writes.

Interestingly, Malibu Media doesn’t mention whether it’s actively resolving these tax issues. At the moment, it also remains unclear when the company’s corporate status was suspended. According to OpenCorporates this happened somewhere between July last year and January 2021.

In any case, Malibu Media’s CEO is no stranger to this type of suspension. One of her other companies, Colette Productions, has been suspended in California over tax troubles since 2019. In addition, Colette Holdings and Colette Properties were suspended by the California Secretary of State.

Meanwhile, a new corporation named Malibu Media Holdings LLC has become active in Nevada, listing Pelissier as the director.

PSA: You have one day until Nintendo delists Super Mario 3D All-Stars

Today's Dealmaster is headlined by more of a PSA than an outright deal: if you're a Nintendo Switch owner who has been on the fence about buying Super Mario 3D All-Stars, you have about a day left until Nintendo removes the game from digital stores and stops shipping physical copies to retailers.

Nintendo has positioned the retro-game collection as a "limited production" to celebrate its mascot's 35th anniversary since the game's launch last September. Earlier this month, the company reiterated that March 31 would be the title's official cutoff date. The game will still be playable after that point, and those who've previously purchased a digital copy will still be able to re-download it from the Nintendo eShop if they've deleted it from their Switch. Those who've bought an unredeemed digital copy will still be able to download the title after March 31 as well. But officially, Nintendo says it will no longer sell the game in the eShop after that date and that any remaining physical copies will only be available until stock runs out.

As of this writing, the game is still widely available. It's possible that third-party retailers will still have copies in stock for a few days after March 31, but if you don't want to risk having to go through the reseller market, here's a list of stores where the game is still up for purchase:

Star Wars: The Bad Batch trailer arrives ahead of May the Fourth launch

Today’s trailer follows massive cast announcement for Disney+’s Obi-Wan.

This week's one-two Disney+ news punch revolves around Star Wars—a PB-and-choc combo of TV series that has so far paid off richly, especially after the shaky conclusion to the franchise's latest film trilogy.

First up is the newest Star Wars series to debut, coming in barely over a month. We learned last month that new series Star Wars: The Bad Batch is slated to launch on Tuesday, May 4 (huh, we wonder why they picked that date). On Tuesday, Disney followed that news with the premiere of that CGI-animation series' first trailer, which immediately follows in the footsteps of Clone Wars' revival on Disney+ a little over a year ago. The new series also sees longtime Clone Wars steward Dave Filoni return as co-executive producer.

Clone Wars' seventh season opened by focusing squarely on the Bad Batch, a ragtag group of clone troopers (also known as Clone Force 99) whose mutations turned them into supersoldiers above the rest of the clone fray. Their combination of action-filled missions and comic-relief banter set a solid tone for a season that barreled toward epic set pieces long-teased by Filoni, particularly the Siege of Mandalore.

Police say they found mafia fugitive on YouTube, posting cooking tutorials

An alleged mafia fugitive hiding from Italian police in the Dominican Republic was arrested after being spotted showing off his cooking skills in instructional videos he posted on YouTube, according to news reports.

Marc Feren Claude Biart, an alleged member of the 'Ndrangheta criminal organization based in southern Italy, reportedly hid his face in the cooking videos but failed to hide his tattoos, leading to his identification. The man had been hiding since law enforcement "ordered Biart's arrest in 2014 for criminal drug trafficking on behalf of the 'Ndrangheta's Cacciola clan," according to The Washington Post.

The 53-year-old Biart didn't keep his recipes secret but "was always careful to hide his face in his Italian cooking tutorials, filming the YouTube videos while laying low from police on a sandy beach in the Caribbean," the Post wrote. It's not clear whether the videos are still online, but Biart and his wife "appeared to have uploaded several cooking tutorials for Italian recipes to YouTube, including ones where Biart's tattoos were visible," the Post wrote.

Apple will reveal the next versions of iOS, macOS at WWDC21, starting June 7

It will be entirely online again, as expected.

Apple will host its annual Worldwide Developers Conference (WWDC) on schedule this year, with the event kicking off on June 7 and concluding on June 11. Like last year, it will be an online-only affair as the world continues to grapple with the COVID-19 pandemic. All the event's offerings will be free for anyone who has an Apple developer account.

The company typically uses this event to announce new versions of its various operating systems (macOS, iPadOS, iOS, watchOS, and tvOS) and detail the software's new features and changes. WWDC is sometimes, though not always, used to announce new hardware products, too, and it's often the event Apple uses to explain very major changes in direction, should they be imminent. For example, Apple revealed the details of its custom-made silicon transition at last year's conference.

Apple's press release notes that the usual components will be there. There will be a keynote to kick things off, followed by "state of the union" presentations that drill deeper on each platform. Then, Apple will offer video sessions on specific features—using the Metal graphics API to make augmented reality applications, in one hypothetical example—throughout the week. The conference will also include one-on-one lab appointments "offering technical guidance" to developers, Apple says.

Nike sues over “Satan Shoe,” disavowing all connection to soul soles

Nike really doesn’t like anyone thinking it made or endorses the Satan Shoe.

Nike is suing the company behind a viral, limited-edition custom shoe, arguing that the unauthorized custom work dilutes its brand and creates a false impression that Nike approves the controversial design.

The Satan Shoe, a collaboration between a company called MSCHF and rapper Lil Nas X, is a tie-in to the rapper's new single, "Montero (Call Me By Your Name)," released last Friday. The music video for the song (contains explicit language and extremely unambiguous sexual imagery; do not watch at work or around small children) tells a story "of sin, banishment, and redemption" that ends with Lil Nas X descending into Hell, giving Satan the lap dance of a lifetime, then deposing him and claiming the devil's horns for his own.

"Montero" proved to be an immediate viral sensation; in five days, it has racked up about 45 million YouTube views, and the song, the singer, and various related terms ("Satan," "mark of the beast," "devil," etc.) have been trending on Twitter and other platforms nonstop for days.
