Op-ed: The patent bargain is seriously busted.
Elizabeth Holmes, like Benjamin Franklin and Edith Clarke, challenged a basic assumption. Why, she wondered, do doctors and researchers need to take so much blood from a person when running tests? She’s proven that they don’t. Her innovation—which she has patented—requires the patient to surrender a mere drop of blood, and that small sample is then used for numerous experiments. It’s no surprise that the company she founded on this technology is thriving.

When Patent Office Director Michelle Lee gave that speech, Theranos appeared to be one of the most impressive companies in Silicon Valley. But later that year, the public learned that Holmes hadn’t “proven” anything. Whistleblowers told The Wall Street Journal that Theranos wasn’t even using its own devices for most of its blood testing. Holmes had apparently spent more than a decade building a company based on unrealistic or outright false claims about its revolutionary technology.
For any disaster as large as Theranos, there’s plenty of blame to go around, of course. Both Holmes and former COO Sunny Balwani now face federal fraud charges. Theranos’ star-studded board of directors failed to do adequate oversight. Walgreens ignored warning signs before launching its in-store partnership. Some VCs and journalists were too eager to believe Theranos’ unproven claims.
But the patent system also played an important, and often overlooked, role in the situation. The USPTO gave out patents much too easily, giving Theranos early credibility it didn’t deserve. Theranos then used these patents to attract staff, investors, and business partners. The company would last for 10+ years and burn through half a billion dollars before the truth finally emerged.

Archaeologist studied tomb inscriptions and matched names to historical records.

Modern visitors to the ruins of the two main cities destroyed by the eruption of Mount Vesuvius in 79 AD are usually enthralled by the site of plaster casts of those who were killed, frozen in the midst of action. The catastrophic eruption wiped out several nearby towns and killed thousands of people. But some survived, and Miami University archaeologist and historian Steven Tuck thinks he knows where they ended up. He created a database of Roman names and matched them with records from other cities in Italy, describing his findings in a forthcoming paper in the journal Analecta Romana.
"Tuck's combination of history and archaeology has produced strong evidence that it is possible to trace Vesuvian refugees," bioarchaeologist Kristina Killgrove wrote at Forbes about this new work. "He finds that many refugees settled on the north side of the Bay of Naples, and that families tended to move together and then to marry within their refugee community."
The vast majority of people in Pompeii and Herculaneum—the cities hardest hit—perished from asphyxiation, choking on the thick clouds of noxious gas and ash. But at least some of the Vesuvian victims probably died instantaneously from the intense heat of fast-moving lava flows, with temperatures high enough to boil brains and explode skulls. Less is known about the fortunate survivors.

Astronauts or astro-nots?

Perhaps within a matter of a months, a handful of customers will board a spacecraft and fly above Earth's atmosphere to float for a few minutes, where they will presumably gawk at our planet's graceful curvature. Shortly after this, dozens, and soon hundreds, will follow. Space enthusiasts have made such promises about space tourism for nearly a decade, but in 2019 it's finally coming true.
In the last three months, Virgin Galactic has completed two crewed test flights above 80km. And with its flight-tested New Shepard launch system, Blue Origin remains on track to blast its own people into space later this year. Both spacecraft can carry up to six passengers. Neither company has begun commercial operations, but these flights appear imminent. Later this year, suborbital space tourism should finally transition from long-promised to something you can do if you're rich enough. Next year, we will likely see dozens of commercial flights.
These welcome successes have raised a question, however: just what do we call these people?

Many will get a strongly-worded letter from their ISP asking them to stop downloading and sharing copyrighted content. Others, targeted by so-called “copyright trolls”, aren’t so lucky, since the letters they receive contain a demand for cash, if they are to avoid a costly legal process.
While the names of content owners are clearly listed in court documents as plaintiffs, there is an industrial-scale system run by a company called GuardaLey operating behind the scenes in many such cases in both the US and Europe.
Perhaps most famously, GuardaLey was behind the record-breaking The Hurt Locker and The Expendables lawsuits in the US but make no mistake, the company is the engine behind cases targeting many thousands of individuals all around the world.
GuardaLey (and close partners) provide the tracking data, business structure, and experience to enable these lawsuits to go ahead, actively monitoring file-sharing networks then approaching content companies with an offer to help generate revenue from alleged pirates.
Despite its scale, GuardaLey operates somewhat silently, rarely making the headlines itself. It was a surprise, therefore, to see a new announcement from the company that it had entered into a “joint venture” early February with American Films, Inc.
“This is a significant opportunity for American Films, Inc. given our team’s knowledge in the data and film industry, we bring great synergies previously unavailable to this territory and industry,” said American Films CEO John Carty.
The “joint venture” just announced is somewhat intriguing.
Firstly, American Films, Inc, “will own 100% of this joint venture company” which will “take over the USA” operations of GuardaLey. Secondly, given the name, American Films doesn’t appear to have any films, at least as far as its GoDaddy website-builder page shows.
“American Films Inc. is an emergent entertainment industry company focused on opportunities for equity investors,” its promo material reads.

That said, according to Bloomberg data, “American Films, Inc. does not have significant operations” and was previously involved in a research project being “conducted at NYU relating to DNA Nanotechnology.”
Despite not appearing to have any experience in the file-sharing market, American Films (Pink Sheets: AMFL) will join GuardaLey in a joint venture that will work with an all-new “strong setup of prestigious law firms across the nation” to “provide education” to copyright infringers.
