YouTube Ripper Wins Dismissal of Record Labels’ US Piracy Lawsuit

The Russian operator of the YouTube-ripping sites FLVTO.biz and 2conv.com has scored an important legal win against several major record labels in the US. A Virginia federal court dismissed the piracy lawsuit after concluding that it doesn’t have personal jurisdiction over these types of sites if they are operated from abroad.

YouTube rippers are seen as the largest piracy threat to the music industry, and record labels are doing their best to shut them down.

In 2017, YouTube-MP3, the world’s largest ripping site at the time, shut down after being sued, and several other folded in response to increased legal uncertainty.

Not all stream-ripping sites throw in the towel without a fight though. FLVTO.biz and 2conv.com, owned by Russian developer Tofig Kurbanov, remained online despite being sued by several record labels last August.

Where other site owners often prefer to remain in the shadows, Kurbanov filed a motion to dismiss the case. According to the defense, the court has no jurisdiction over the matter. Only a small fraction of the visitors come from the US, and the site is managed entirely from Russia, it argued.

The RIAA labels, including Universal, Warner Bros, and Sony, clearly disagreed. In response, they argued that the operator of FLVTO.biz and 2conv.com downplays the connections to the US and Virginia. Therefore, he should stand trial there.

Yesterday, US District Court Judge Claude M. Hilton ruled on the matter. In a 14-page opinion, he clearly sides with the operator of the YouTube rippers. Kurbanov doesn’t have to stand trial in the US so the case was dismissed.

The ruling is merely about jurisdiction and doesn’t make an assessment of the alleged copyright infringements. The court carefully reviewed how the site operates and found no evidence that they purposefully targeted either Virginia or the United States.

The sites are available in the US and have plenty of visitors there, but that by itself is not enough.

“Even if the Websites’ servers knew exactly where the users were located, any interaction would still be in the unilateral control of the users as they initiate the contacts,” Judge Hilton’s opinion reads.

There could be personal jurisdiction if there’s a “commercial contract” involved. However, that’s not the case here. The site generates revenue from users through advertisements, but that’s not seen as a basis for a commercial contract, the court concludes.

“As the Websites are semi-interactive, the interactions with the users are non-commercial, and there were no other acts by the Defendant that would demonstrate purposeful targeting, the Court finds that Defendant did not purposefully avail himself of the benefits and protections of either Virginia or the United States.

“The Court finds that exercise of personal jurisdiction over Defendant would be unconstitutional as a violation of due process…” Judge Hilton’s opinion adds, before dismissing the case.

In addition, the opinion stresses that without personal jurisdiction the record labels don’t have the option to refile the case in California or elsewhere in the US.

The ruling

Val Gurvits, one of the attorneys who represented the site operator, is thrilled with the outcome. He believes this will also be beneficial to other foreign sites that offer similar functionality.

“This decision goes a long way towards curbing the copyright owners’ misuse of the US legal system to bully foreign website operators,” Gurvits informs TorrentFreak.

In many copyright-related cases, foreign defendants decide not to appear at all, but this case shows that fighting back can pay off.

“All too often plaintiffs file actions in US courts against foreign defendants that have no connections with the US – and all too often foreign defendants are subjected to default judgments for failure to appear in a US court,” Gurvits says.

“We are happy we were able to save our client from having to defend this action in a US court thousands of miles away from where the relevant business activities take place,” he adds.

The major record labels have yet to comment on the outcome. TorrentFreak reached out to the RIAA for a response, but we haven’t heard back thus far.

Terabyte-using cable customers double, increasing risk of data cap fees

US cable Internet customers are using an average of 268.7GB per month, and 4.1 percent of households use at least 1TB, according to new research by the vendor OpenVault.

Households that use at least 1TB a month are at risk of paying overage fees because of the 1TB data caps imposed by Comcast and other ISPs. Terabyte users nearly doubled year over year, as just 2.1 percent of households hit the 1TB mark last year, according to OpenVault.

Cable Internet providers use OpenVault products to track "broadband data usage consumption levels for millions of subscribers," the company says. This gives OpenVault visibility into how much data broadband customers use each month.

A year ago, we highlighted NPD data to show that worries about the impending death of the console gaming industry were way overblown. One year later, NPD's annual sales estimates for 2018 show the US console business is doing even better, thanks in large part to the continued success of the Nintendo Switch.

NPD reports that the Switch was the best-selling system in the US for 2018 in terms of both unit sales and total hardware revenue. That said, the system didn't quite rise to the sales level the PS4 hit in 2015, its extremely strong second full year on store shelves.

December in particular was a banner month for Nintendo's portable/TV hybrid, though. You need to go back to the height of Nintendo Wii mania to find a month where any console made more hardware revenue (December 2009) or sold more units (December 2010) in the US.

US asks Canada to turn over Huawei’s CFO on alleged sanctions violations

The United States government said Tuesday that it is seeking the extradition of Huawei executive Meng Wanzhou from Canada. In addition to being the chief financial officer of Huawei, Meng is also the daughter of Huawei founder Ren Zhengfei.

Meng was arrested last month on charges that the Chinese telecom giant and affiliated companies have been doing business in Iran in violation of US sanctions laws—and that Meng had been directly involved in covering up Huawei's Iran dealings.

Meng sits on the board of a Huawei partner company called Skycom Tech that US and Canadian authorities have accused of doing business with Iran. "In late 2010, Skycom’s office in Tehran offered to sell at least 1.3 million euros worth of HP gear" to a major Iranian telecommunications provider, Reuters reported in 2013.

New Shepard makes 10th launch as Blue Origin aims to fly humans late in 2019

Under clear West Texas skies on Wednesday morning, Blue Origin's autonomous New Shepard launch system made what appeared to be a flawless flight into space and back. After separating from its booster, the spacecraft ascended to a height of 106.9km before returning to Earth by parachute. The booster also made a nominal powered landing.

For Blue Origin, the company's first flight of its reusable New Shepard system in more than six months served a dual purpose. It provided additional test data for the launch system as the company moves closer to crewed flights, and the launch allowed the company to fly eight NASA-sponsored research and technology payloads into space through NASA’s Flight Opportunities program.

During the webcast, Blue Origin's head of sales, Ariane Cornell, said the company was "aiming" to conduct human flights on board New Shepard before the end of 2019 but stressed that Blue Origin would not compromise on safety to meet any arbitrary dates. The company has yet to begin selling tickets for the six-person capsule or set a price for the 11-minute experience that will take passengers above the Kármán line and provide a few minutes of weightlessness.

Health officials in Clark County, Washington have declared a public health emergency for a measles outbreak in an area with a high rate of unvaccinated children.

As of Tuesday January, 22, officials tallied 23 confirmed cases in the county, which is just north of Portland, Oregon. The case count rose rapidly, more than doubling since last week, and will likely continue to rise amid low vaccination levels in the area.

Nearly eight percent of children in Clark County were exempt from standard vaccination for the 2017-2018 school year, according to state records reported by the Washington Post. Breaking down that eight percent, about seven percent of kids had personal or religious exemptions and the remaining one percent or so had medical exemptions. Factoring in the rest of the population, the county is below the 92 percent to 94 percent range some experts consider required to prevent the spread of highly contagious diseases such as measles.
