Minecraft lays its last brick on Xbox 360, other last-gen consoles

PS3, Wii U, Vita owners in search of updates will have to get another version.

Following an announcement earlier this year, Microsoft and Mojang have followed through on bad news for owners of Minecraft on older game systems. Yesterday marked the end of development on the popular game's "legacy" branch.

That means if you still play Minecraft on the game's first-ever console port platform, the Xbox 360, this week's 1.83 patch is the last one you can expect to ever receive. The same goes for owners of the game on PlayStation 3, Wii U, and PlayStation Vita.

Most of the game's modern versions, ranging from iOS and Android to PC and "current-gen" consoles, were unified in a shared-codebase manner by primary developer Mojang earlier this year. This version originated from a "Pocket Edition" codebase and later became known as the "Bedrock" edition. The aforementioned legacy platforms, on the other hand, remained in the development hands of independent Scottish studio 4J. Microsoft's relationship with 4J began in the Xbox 360 era with ports of classic Rare games Banjo-Kazooie and Perfect Dark (which were ported from their original N64 versions, owing to Microsoft's current ownership of those franchises).

A few months ago, Microsoft let slip a forthcoming Windows 10 feature that was, at the time, called InPrivate Desktop: a lightweight virtual machine for running untrusted applications in an isolated environment. That feature has now been officially announced with a new name, Windows Sandbox.

Windows 10 already uses virtual machines to increase isolation between certain components and protect the operating system. These VMs have been used in a few different ways. Since its initial release, for example, suitably configured systems have used a small virtual machine running alongside the main operating system to host portions of LSASS. LSASS is a critical Windows subsystem that, among other things, knows various secrets, such as password hashes, encryption keys, and Kerberos tickets. Here, the VM is used to protect LSASS from hacking tools such that even if the base operating system is compromised, these critical secrets might be kept safe.

In the other direction, Microsoft added the ability to run Edge tabs within a virtual machine to reduce the risk of compromise when visiting a hostile website. The goal here is the opposite of the LSASS virtual machine—it's designed to stop anything nasty from breaking out of the virtual machine and contaminating the main operating system, rather than preventing an already contaminated main operating system from breaking into the virtual machine.

DC sues Facebook over Cambridge Analytica scandal

The attorney general of the District of Columbia has sued (PDF) Facebook, alleging violations of local consumer protection laws.

In a statement sent to reporters on Wednesday, AG Karl A. Racine said that the social media giant did not adequately protect users’ data, "enabling abuses like one that exposed nearly half of all District residents’ data to manipulation for political purposes during the 2016 election."

The lawsuit is believed to be the first major regulatory lawsuit stemming from the Cambridge Analytica scandal that broke earlier this year.

Judge Recommends Dropping ISP Grande’s DMCA Safe Harbor Defense

Texas-based Internet provider Grande Communications has no right to a safe harbor defense, US Magistrate Judge Andrew Austin argues. The ISP failed to adopt and reasonably implement a repeat copyright infringer policy. Judge Austin, therefore, recommends granting the RIAA labels’ motion for summary judgment on the matter. And there’s more bad news too.

Last year several major record labels, represented by the RIAA, filed a lawsuit against ISP Grande Communications accusing it of turning a blind eye to pirating subscribers.

According to the RIAA, the Internet provider knew that some of its subscribers were frequently distributing copyrighted material, but failed to take any meaningful action in response.

Grande refuted the accusations and filed a motion to dismiss the case. The ISP partially succeeded as the claims against its management company Patriot were dropped. The same was true for the vicarious infringement allegations.

The labels were not willing to let go so easily. They pushed on with several new filings, including a motion for summary judgment, arguing that Grande has no safe harbor defense.

In order to enjoy safe harbor protection, the DMCA requires ISPs to adopt and reasonably implement a policy for terminating the accounts of repeat copyright infringers. According to the labels, it is clear that Grande failed to do so. As such, the company should be held directly liable.

Yesterday, US Magistrate Judge Andrew Austin issued his “report and recommendation” on the matter, which delivers a significant setback for the Internet provider.

According to the Judge, the undisputed evidence shows Grande had a policy that allowed it to terminate repeat infringers, but that the ISP failed to act on this for years. As such, the policy was not adopted and reasonably implemented.

“Grande affirmatively decided in 2010 that it would not enforce the policy at all, and that it would not terminate any customer’s account regardless of how many notices of infringement that customer accumulated, regardless of the source of the notices, and regardless of the content of a notice,” Judge Austin writes.

The evidence shows that Grande did not terminate a single repeat infringer between October 2010 and June 2017. This was effectively confirmed by the ISP’s own corporate representative.

“A ‘reasonably implemented’ termination policy requires that the policy be enforced, and not just adopted. Because the evidence is undisputed that Grande never enforced its policy during the relevant time period, it is precluded from raising the DMCA safe harbor defense in this case.

“It is hard to imagine a case in which it is more clear that the DMCA safe harbor is not available,” the recommendation reads.

In its defense, Grande argued that it did enforce a repeat infringer policy after the lawsuit was filed but, according to the Judge, this was “too little too late.”

The Internet provider also argued that terminating customers wasn’t appropriate because the copyright infringement notices sent by Rightscorp were flawed. However, Judge Austin concludes that this is no defense, as there is no evidence that Grande ever considered terminating a user.

On top of that, the concerns regarding Rightscorp’s notices don’t explain why similar complaints from other sources were also disregarded.

“Yet another failure with Grande’s argument about the Rightscorp notices is that it does not address the several hundred thousand copyright infringement notices it received from companies other than Rightscorp,” Judge Austin writes.

In weighing the arguments the Judge looked closely at the BMG v. Cox case, which was very similar. In that matter, the court concluded that Cox didn’t have a safe harbor defense and Judge Austin argues that that same should apply to Grande.

If the U.S. District Court Judge adopts this recommendation, it will be a major win for the labels of the RIAA. Without a safe harbor defense, ISPs are not shielded from liability for the actions of pirating subscribers.

And there is more bad news for the ISP as well.

Grande requested summary judgment in its favor on a variety of liability issues, including direct infringement, willfulness, damages, and ownership of copyright. These are all under recommendation to be denied, except for two limited issues regarding the alleged violation of reproduction or public performance rights.

The RIAA labels also submitted a cross-motion on these liability issues, requesting a ruling in their favor, but that was denied as well. This means that the matters will be decided at trial.

While Judge Austin’s recommendations have yet to be adopted, both reports and recommendations have definitely not improved the outlook for Grande.

The early Universe was a strange place. The Universe was so dense and hot that atoms and nuclei could not form—they would be ripped apart by high-energy collisions. Even protons and neutrons could not survive. And that left us with quarks and gluons flying around to form something called a quark-gluon plasma.

We’ve observed these in the lab, but those findings are not without controversy—the quark-gluon plasma seemed to form under unexpected conditions. Now, it seems that science has done its job and done the experiments to confirm that, yes, those observations were almost certainly quark-gluon plasmas.

Quarks? Gluons? English or Klingon?

The Universe is divided into families of particles. On one side, we have the leptons: electrons and their overweight cousins, muons and tauons (and their invisible friends, a corresponding neutrino). Then there are the force carriers: photons, W and Z bosons, the Higgs, and gluons. On the other side we have a charming family of colorful quarks. All of these particles are a bit like Legos: put them together in various ways to create a Universe (the instruction book can be a bit overwhelming though).
