What to expect now that AT&T officially owns Time Warner

AT&T completes Time Warner buy, days after beating government lawsuit.

AT&T yesterday completed its acquisition of Time Warner Inc., two days after a federal judge ruled against a Department of Justice (DOJ) attempt to block the deal. The DOJ could still appeal the ruling, but it agreed not to seek a stay pending appeal, allowing the merger to be completed.

You can expect more personalized advertisements as AT&T combines a major programmer with its DirecTV, home broadband, and mobile services.

By adding Warner Bros., HBO, and Turner to AT&T's TV and broadband services, the combined company will "bring a fresh approach to how the media and entertainment industry works for consumers, content creators, distributors and advertisers," AT&T CEO Randall Stephenson said in the merger completion announcement. AT&T will "offer customers a differentiated, high-quality, mobile-first entertainment experience," he said.

Epic’s Fortnite Copyright Infringement Claims Need Work, Court Says

Fortnite developer and publisher Epic Games hoped to get a default judgment against an alleged cheater from Russia, but the court is not yet convinced. US Magistrate Judge Laurel Beeler believes that the copyright infringement claims are not sufficient to grant a permanent injunction and has asked the developer to clarify several issues in a new complaint.

Frustrated by thousands of cheaters who wreak havoc in Fortnite’s “Battle Royale,” game publisher Epic Games decided to take several to court.

The game developer isn’t trying to bankrupt these people financially. It is mainly interested in preventing them from cheating in the future.

The main strategy thus far has been to ‘settle’ the cases. Several accused cheaters have signed consent judgments, promising not to cheat or engage in any copyright infringing activity going forward.

This tactic doesn’t work in all cases. One of the accused, a man from Russia going by the name of Konstantin Vladimirovich Rak, has failed to respond to the allegations in court.

This failure prompted Epic Games to file for a default judgment, requesting an injunction that would prevent the defendant from using Epic’s copyrighted works to develop cheats, as well as other infringing activity.

Without Rak being able to put up a defense, one might expect an easy win for Fortnite’s developer, but that’s certainly not the case.

In an order published this week, United States Magistrate Judge Laurel Beeler notes that the balance currently weighs against granting the default judgment.

Judge Beeler is specifically concerned with the merits of Epic’s claims and the sufficiency of the complaint. This includes the copyright infringement accusations, which need work.

One of the claims is that Mr. Rak engaged in direct copyright infringement. This requires Epic to show that the alleged infringer violates its exclusive rights, but that’s not the case here,

“Epic alleges that users can download Mr. Rak’s cheat and then inject the cheat into Fortnite code, but it does not allege that Mr. Rak himself injected the cheat into Fortnite code or created an unauthorized derivative work,” Judge Beeler notes.

In addition, the defendant allegedly displayed the cheat in action by posting gameplay on YouTube, thereby violating its exclusive right ‘to perform the copyrighted work publicly.’ However, without further details, the court is not convinced that this is copyright infringement.

“Epic does not allege what exactly Mr. Rak publicly performed or address whether its copyright extends to that performance. On this issue, Epic’s complaint says only that the Rak Video ‘showed full-screen gameplay using the cheat,’ without more,” Judge Beeler writes.

Then, there is the issue of whether posting gameplay material on YouTube is, in fact, copyright infringement. The court doesn’t want to draw any hard conclusions without hearing both sides but concludes that Epic’s claims are not sufficient.

“[T]the court declines to rule on whether posting a video on YouTube of gameplay from a video game does or does not infringe upon a copyright holder’s […] rights. The court will just say this: if it does infringe, Epic has not met its burden of demonstrating that to the court.”

Besides issues with the copyright claims, the trademark allegations are also lacking. Epic claims that the defendant uses the Fortnite trademark without authorization, but doesn’t link this to the sale of goods or services, as it should.

“Epic does not plead that Mr. Rak proposed any commercial transaction or offered anything for sale, much less that consumers would be misled into buying something from him or any other third party under the mistaken belief that it was coming from Epic,” Judge Beeler writes.

Before making a final recommendation, the court will allow Epic to amend its complaint to address the deficiencies. In addition, Epic has to provide the defendant with Russian translations of its filings.

If it chooses not to do so, however, the default judgment will be denied.

George Lucas reveals his plan for Star Wars 7 through 9—and it was awful

Friday morning was going pretty well, all things considered. I was sat at my desk, editing some photos and having breakfast. Then Lee Hutchinson pinged me on slack and ruined it all. "It’s even worse than we could have possibly imagined," said my boss. "and, as Han Solo said, I can imagine a lot." Accompanying this missive was news about George Lucas' plans for Star Wars episodes 7-9, and my god would they have sucked. Forget the First Order or Porgs, forget BB-8 and Poe Dameron. Imagine, if you can, our heroes shrinking down like the Fantastic Voyage to go meet some midichlorians. There, your breakfast is ruined now too.

The info comes from an interview between Lucas and another billionaire filmmaker, James Cameron. The latter made a series about science fiction, and the transcript of their interview was recently published in the companion book. The bombshell drops after a brief insight into Lucas' view of the environmental damage we're causing the Earth. "We're not going to save the planet", Lucas regularly tells people but follows up by saying we'll end up like Mars. But Mars is fine, he thinks, and is sure we'll find life there. And in the rest of the solar system too.

This thought of microscopic alien life spurs a memory. "Everybody hated it in Phantom Menace" [when] we started talking about midicholorians," Lucas says. Uh-huh, we sure did. Because it was a really dumb idea. What follows should make every Star Wars fan send a note of gratitude to whomever at Disney decided to buy the franchise and take it away and out from under Lucas' control.

How startups are building driverless cars without Google’s billions

There's near-universal agreement that Google spinoff Waymo is the leading company in the driverless-vehicle business. And Waymo's strategy for developing fully driverless cars is very expensive. Before launching a commercial driverless car service, Waymo needs to convince itself—and the world—that its cars will be at least as safe as human drivers.

That has meant racking up millions of test miles on public roads, a process that has taken several years and cost Waymo well over $1 billion.

Waymo's more established competitors—including Uber, GM's Cruise, and the Ford-aligned Argo.ai—are pursuing a similar strategy. But a number of startups is also trying to build fully autonomous cars. And many of these companies simply don't have the money it takes to follow Waymo's lead. They need a different strategy—one that allows them to bring a product to market more quickly and at lower cost.
