Kim Dotcom Files Complaint With Human Rights Tribunal Over “Lost Data”

Kim Dotcom has revealed that a judgment requiring authorities to hand over information to him hasn’t been complied with due to apparent IT system issues. According to the Megaupload founder, data generated before December 2013 is no longer available to be handed over. In response, Dotcom’s lawyers have filed an urgent submission with the Human Rights Tribunal demanding immediate action.

It’s been more than six years since New Zealand and United States authorities collaborated to take down Megaupload. While the site itself is long gone, founder Kim Dotcom is putting up a determined fight.

At every twist and turn of his epic legal battle, Dotcom has challenged the efforts of authorities in multiple jurisdictions. The New Zealand courts, in particular, have seen sustained action.

From the beginning, Dotcom has aimed to extract as much information about his case as possible. From the seized data that was present on Megaupload’s servers to the information held by New Zealand authorities, Dotcom has chased down every bit, byte, letter, and document. At almost every turn, he’s met resistance.

In a series of tweets this morning, Dotcom has revealed a surprising turn of events in response to an order compelling authorities to provide him with data. New Zealand police have informed Dotcom’s lawyers that they haven’t complied with Human Rights Tribunal judgment because the information requested was generated before December 2013 and is no longer in the new IT system.

4.5 years later…..it’s all gone

“According to the new Attorney General David Parker (Labour Govt) he can’t comply with a judgment to provide me with information I’m entitled to because he doesn’t have access to the data of the previous Attorney General. What an utterly embarrassing mockery of New Zealand law,” Dotcom explains.

Information provided by Dotcom shows that the current Attorney-General David Parker has provided information held during his administration. However, the majority of the data requested by Dotcom’s team related to the term covered by his predecessor Chris Finlayson.

Citing several paragraphs of the New Zealand government’s Cabinet Manual relating to ‘Convention on access to Cabinet records of a previous administration’, Parker says he does not have access to information held under Finlayson’s watch. Dotcom’s lawyers immediately complained.

“This is an artificially narrow interpretation of the Tribunal’s order and the relevant rules and defeat the purpose of the order,” they wrote in a submission filed with the Human Rights Tribunal this morning, which also seeks an order for the government to comply with the Tribunal’s earlier judgment by July 31.

With that done, Dotcom turned his attention to a group of people he previously hoped would develop into allies but have yet to do so.

When the 2012 raid on Megaupload and Dotcom took place, it was under a National Party government. When they lost power to Labour in 2017, Dotcom appeared to adopt a more gentle tone, perhaps hoping that the new government would take the opportunity to declare his case a National Party mistake and one best forgotten.

Since it seems clear that isn’t going to happen, Dotcom’s tone is now changing for the worse.

“Let it be known. The new Labour government is continuing the unlawful persecution of my family while breaching every law and judgment in the land to prevent me from getting access to information that the New Zealand Supreme Court ruled I should have,” he warned this morning.

“The gloves are coming off!”

China has begun censoring mentions of HBO comedian John Oliver on social media and restricting access to the HBO website. The crackdown began late last week after Oliver ran a scathing 20-minute segment on his HBO show, Last Week Tonight, mocking Chinese president Xi Jinping.

"Attempts to send posts Friday with either the terms 'John Oliver' or 'Last Week Tonight' on the Sina Weibo microblog were met with failure messages saying 'the content contains information that violates relevant laws and regulations,'" according to The Hollywood Reporter.

Oliver's segment criticized the increasingly authoritarian policies of Xi's government. It also highlighted how Chinese authorities have banned images of Winnie the Pooh after people started mockingly comparing Xi to the cartoon teddy bear.

Hyperthreading under scrutiny with new TLBleed crypto key leak

Last week, developers on OpenBSD—the open-source operating system that prioritizes security—disabled hyperthreading on Intel processors. Project leader Theo de Raadt said that a research paper due to be presented at Black Hat in August prompted the change, but he would not elaborate further.

The situation has since become a little clearer. The Register reported on Friday that researchers at Vrije Universiteit Amsterdam in the Netherlands have found a new side-channel vulnerability on hyperthreaded processors that's been dubbed TLBleed. The vulnerability means that processes that share a physical core—but which are using different logical cores—can inadvertently leak information to each other.

In a proof of concept, researchers ran a program calculating cryptographic signatures using the Curve 25519 EdDSA algorithm implemented in libgcrypt on one logical core and their attack program on the other logical core. The attack program could determine the 256-bit encryption key used to calculate the signature with a combination of two milliseconds of observation, followed by 17 seconds of machine-learning-driven guessing and a final fraction of a second of brute-force guessing.

Marijuana drug wins FDA approval—a first that may change federal regulations

Marijuana now has an accepted medical use.

The US Food and Drug Administration announced today, Monday June 25, the approval of the country’s first marijuana-based prescription medication. The drug is called Epidiolex and is a plant-derived oral solution of cannabidiol (CBD)—a chemical component of marijuana that does not cause intoxication or a euphoric “high.” The FDA approved it for use in patients aged two and older who suffer from rare and severe forms of epilepsies known as Lennox-Gastaut syndrome and Dravet syndrome, which can develop early in childhood. Epidiolex’s approval also marks the first time the FDA has approved a drug to treat Dravet syndrome.

With the historic approval, the London-based company behind the drug, GW Pharmaceuticals plc, is expecting another consequential decision in the coming weeks: getting the US Drug Enforcement Administration to reclassify CBD. The move could open the doors to other marijuana-derived medications as well as ease heavy restrictions on marijuana-related research.
