Cloudflare Fails to Exclude Daily Stormer Evidence From Piracy Trial

A California federal court has denied Cloudflare’s request to exclude evidence related to its termination of neo-Nazi site Daily Stormer from the upcoming piracy liability trial against ALS Scan. The CDN provider fears that mentioning the site at trial could cloud the perception of the jury, but District Court Judge George Wu was not receptive to this argument.

Last summer Cloudflare CEO Matthew Prince decided to terminate the account of controversial neo-Nazi site Daily Stormer.

“I woke up this morning in a bad mood and decided to kick them off the Internet,” he announced.

The company’s lawyers later explained that the move was meant as an “intellectual exercise” to start a conversation regarding censorship and free speech on the internet. However, this discussion went much further than Prince had planned.

For years, Cloudflare had a policy not to remove any accounts without a court order, so when this was exceeded, eyebrows were raised. In particular, copyright holders wondered why the company could terminate this account but not those of the most notorious pirate sites.

This is also why The Daily Stormer removal became an issue in the piracy liability case previously filed by adult entertainment publisher ALS Scan. After Cloudflare’s CEO was questioned on the matter, it could be raised before a jury during the trial as well.

Cloudflare didn’t fancy this prospect. In March, the company asked the court to preclude any evidence related to Daily Stormer or other hate groups from the upcoming trial, fearing that it would lead to “guilt by association.”

“The apparent reason that ALS seeks to offer is not for its probative value but rather for its distracting emotional impact,” Cloudflare argued.

“Given the strong feelings such evidence would almost certainly arouse among members of the jury, this evidence creates an unwarranted and impermissible risk of unfair prejudice to Cloudflare.”

However, California District Court Judge George Wu was not receptive to this argument. Following a hearing on the matter last week the Judge denied the motion, which means that ALS is allowed to use the Daily Stormer case at trial.

“[Cloudflare’s motion] to Exclude Evidence Relating to Provision or Termination of Services to Hate Groups is DENIED.”

In hindsight, Cloudflare’s decision to disconnect Daily Stormer the way it did might not have been the best option, but t’s too late now.

According to recent court filings AS and Cloudflare have tried to reach a settlement but thus far that hasn’t happened. This means that the case will move to the scheduled trial, unless both sides can make peace beforehand.

Anheuser-Busch just bought 800 fuel cell Nikola trucks

On a quarterly financial call Wednesday afternoon, Tesla CEO Elon Musk briefly spoke about a new lawsuit filed by Nikola Motor Company, a Salt Lake City-based hydrogen fuel cell truck startup. Musk said it was a "laughable lawsuit from some company called 'Nikola.'"

Whatever the merits of the lawsuit itself, large shipping companies like US Xpress and Ryder think Nikola Motor Company is more than just "some company." Now, it seems, Anheuser-Busch, one of the largest beer producers in the US and a subsidiary of multinational conglomerate AB InBev, is getting on the Nikola truck train, too. On Thursday, Anheuser-Busch announced that it would buy a sizable 800 hydrogen fuel cell trucks from Nikola Motor company to be delivered between 2020 and 2025.

Like Tesla, Nikola has yet to deliver a zero-tailpipe-emissions truck to a customer. Unlike Tesla, the company has not yet delivered any kind of mass-produced vehicle to a customer at all.

It’s a made-up holiday, but there are at least a few discounts worth noting.

It's May the Fourth, which means it's time for Star Wars fans to celebrate their favorite small independent film series. "Star Wars Day," as it's known, may only exist on May 4 because of a cheeky pun—"May the Fourth be with you," for those who've never put two and two together—but for a manufactured holiday it has gained a surprising amount of traction. Special screenings and costume-heavy celebrations are now held annually around the world to celebrate.

Perhaps most of all, May 4 has become a time for retailers to discount and sell lots of Star Wars-themed products. Now, this still isn't a formal holiday, so there's not a truckload of genuine deals out there, and you'll have to be a pretty hardcore Star Wars fan to really get the most out of all of this. But if you're the kind of person who has strong feelings about Alden Ehrenreich or Figrin D'an and The Modal Nodes, there are at least a handful of noteworthy discounts on games, gadgets, and assorted knick-knacks going on today.

AT&T explains why it blocked Cloudflare DNS: It was just an accident

AT&T blames “unintentional IP address conflict,” promises to fix it.

AT&T has been blocking the new Cloudflare DNS service, but AT&T says the blocking was unintentional and that it will fix the problem soon.

The blocking is affecting AT&T home Internet customers who use an AT&T gateway. Cloudflare unveiled its DNS service on April 1, and users in DSLReports forum threads almost immediately started complaining that they couldn't access it. One thread began on April 1, within hours of Cloudflare's announcement.

"I am now unable to reach 1.1.1.1 and 1.0.0.1, which is unfortunate because those are the DNS servers I use," one user wrote.

Activision shows PC some love, plans “significant” resources for Call of Duty

Executives also hint Battle Royale mode could come to Black Ops 4.

Ever since Activision removed dedicated server support from Call of Duty: Modern Warfare 2 back in 2009 (leading to a largely ineffectual attempted boycott from PC players), the popular series has had something of a reputation as a franchise focused first on console players and second on afterthought PC ports. That's especially true when compared to other contemporary shooter franchises like Battlefield. But Activision's orientation toward PC players has been changing a bit over the years, with Destiny 2's recent move to the PC and a hybrid server model being some of the most noticeable signs.

So our ears perked up this week when, in an earnings call Thursday evening, Activision Blizzard President and CEO Coddy Johnson promised that the company has "invested significant dedicated resources and design time" to the PC version of Call of Duty: Black Ops 4. The company wants to "make sure we can deliver a great PC game to serve that community."

Johnson didn't go into any detail on what those "dedicated resources" might mean for PC players, beyond pablum like the game "continu[ing] to push the envelope in innovation" and including "a number of new exciting developments." But he did specifically call out the game's "appeal on growth platforms like PC" as a focal point ahead of a larger gameplay reveal set for May 17.
