DOJ changes “gag order” policy, Microsoft to drop lawsuit

Brad Smith, Microsoft’s attorney: “It is an unequivocal win for our customers.”

The Department of Justice has recently changed its own policy, saying it would now halt the standard never-ending gag orders that companies are faced with when they receive legal demands to handover user data.

In addition, the new three-page memo dated October 19, written by Deputy Attorney General Rod Rosenstein, allows companies to ever tell customers that their data has been surrendered in most cases.

In April 2016, Microsoft sued the DOJ, asking a judge to declare unconstitutional the specific portion of federal law that deals with delayed notice, known as 18 USC 2705(b). Numerous large tech companies have sided with Microsoft in this case, including Apple, Google, Dropbox, Amazon, and Salesforce, among others.

The Pirate Bay’s .SE Domain is Back in Action

The Pirate Bay’s .SE domain name is back in action. The iconic domain was deactivated last week and no longer forwarded to the torrent site. Today the domain is reregistered and is now awaiting the Supreme Court ruling in the ongoing domain name battle.

Last week The Pirate Bay’s .SE domain name expired and, soon after, it was deactivated.

As a result, many people could no longer use their old bookmarks, which traditionally pointed them to the most recent domain of the notorious torrent site.

This appeared to mark the end of this historic domain but today it’s clear that this is not the case. For the past few hours, Thepiratebay.se has been operating as usual again, directing visitors to the current .org domain.

A quick look at the Whois information shows that the domain has been reactivated and the registration updated to October next year. This means that it’s safe, at least for a while.

At the time of writing it’s unclear whether the Pirate Bay listed the deactivation or if this was done on behalf of the Swedish Court of Appeal.

In 2013, a local anti-piracy group filed a motion to have it seized. This resulted in a lengthy legal battle where the Swedish Court of Appeal eventually ruled that The Pirate Bay’s domain had to be confiscated and forfeited to the state.

The forfeiture has yet to take place, though, as the case is still pending at the Supreme Court. Because of this, the Pirate Bay’s owners are not allowed to change the domain details, which may be why it expired initially.

However, without re-registering it, the domain would be released to the public again. This means that outsiders could pick it up, which isn’t supposed to happen, and this is likely why it’s now active again.

The Pirate Bay has yet to comment on the domain issue. When we hear from the team this article will be updated accordingly.

Korean banks sue Newegg, allege online retailer aided massive fraud

Both Newegg, ASI will “vigorously defend” their companies and deny wrongdoing.

Newegg, the well-known online electronics retailer and slayer of patent trolls, has been sued in federal court in Los Angeles by several major Korean banks.

The banks, which include Industrial Bank of Korea, Nonghyup Bank, Keb Hana Bank and Kookmin Bank, allege that Newegg and ASI Corporation pursued fraudulent deals with Moneual.

As Gizmodo noted, the Korean electronics manufacturer sold home theater PCs and cheap robotic vacuum cleaners, among other products. In 2015, Moneual’s then-CEO Park Hong-seok, was convicted by the Seoul Central District Court of fraud, and was sentenced to 23 years in prison, and was ordered to forfeit over $31 million in ill-gotten gains.
