Font Maker Sues Universal Music Over ‘Pirated’ The Vamps Logo

Universal Music Group is being sued by HypeForType, which accuses the record label of using ‘pirated’ copies of its fonts for the logo of The Vamps. The font is widely used for artwork, promotion material and merchandising of the popular British band, and the font creator is looking for a minimum of $1.25 million in damages.

Piracy comes in all shapes and sizes. While record labels regularly see themselves as victims, they can sometimes cross the line as well.

According to HypeForType, which designs, creates, and licenses various custom fonts, this is exactly what record label Universal Music Group did.

The font maker has filed a lawsuit accusing the major label of using its “Nanami Rounded” and “Ebisu Bold” fonts without permission.

The lawsuit centers around fonts used for the logo and merchandise of the popular British band The Vamps. According to a complaint, filed in a New York federal court, Universal failed to obtain a proper license for its use, so they are essentially using pirated fonts.

According to the complaint, designer Stuart Hardie did purchase a basic license in 2013. However, Universal itself hasn’t bought the additional and required license upgrade to use the Nanami Rounded or Ebisu Bold Font Software on a commercial scale.

“Plaintiff requires a license upgrade (‘Special Font License’) for use of its typeface font software in commercial, for-profit usage including, inter alia, on goods for sale,” the complaint reads.

“Upon information and belief, Defendant has used and/or caused others to use unauthorized copies of the Font Software in the creation of The Vamps goods for sale, including, inter alia, clothing, accessories, DVDs, and CDs,” it adds.

HypeForType says that unauthorized use of its font has caused the company significant damages, which it wants to recoup. In addition, the font maker claims any gains and profits Universal made using its fonts.

“At present, the amount of such damages, gains, profits, and advantages cannot be fully ascertained by Plaintiff but are believed to be not less than $1,251,235 together with prejudgment interest and reasonable costs and fees or Statutory Damages under Copyright Law, whichever is greater.”

On top of the damages, HypeForType also requests an injunction preventing Universal, and thus The Vamps, from using the fonts without a proper license. They also want all existing materials, including merchandise, to be destroyed.

While it seems unlikely that The Vamps will stop using their existing logo anytime soon, a substantial settlement might be warranted, if the copyright infringement claims hold up in court. But then again, that’s only fair when you’re ‘stealing’ someone’s work.

Comcast fails to get hidden fee class action suit thrown out of court

Comcast claims it can tack on Broadcast and Sports fees after order is submitted.

A class action complaint against Comcast can move forward after a federal judge rejected a Comcast motion to dismiss it.

The lawsuit, filed in October 2016 in US District Court in Northern California, accuses Comcast of falsely advertising low prices and then using poorly disclosed fees to increase the amount paid by cable TV customers. Those fees are the "Broadcast TV Fee," which had increased from $1.50 a month to $6.50 since 2014, and the "Regional Sports Fee" that rose from $1 to $4.50 since 2015.

These fees are not included in the advertised prices, so customers end up paying higher prices than the ones they are led to believe they will pay, the lawsuit said. When customers question Comcast reps about the fees, "Comcast staff and agents explicitly lie by stating that the Broadcast TV Fee and the Regional Sports Fee are government-related fees or taxes over which Comcast has no control," the complaint said.

Hyperloop One says it sent a demo pod down its test track

Today Hyperloop One claimed that its demo pod reached 192mph (310 kph) on the 500m (1/3 mile) test track that the startup built outside of Las Vegas. Hyperloop One showed off that demo pod last month—it’s basically a 8.7m (28.5 ft) carbon-fiber shell on a magnetically-levitating chassis.

This test run follows on a “Phase 1” test that sent a bare-bones sled down the test track at 70mph. At the time, Hyperloop One had said Phase 2 would involve getting to 250mph, but in a recent press release, the startup said that the 192mph test run this month satisfied Phase 2 development goals. Ars has reached out to Hyperloop One for clarification, and we’ll update when we receive a response.

Super NES Classic pre-orders start later this month

Though the Super NES Classic was announced over a month ago, US retailers have yet to begin offering pre-orders for the console ahead of its September 29 launch (though international pre-orders are already being flipped for inflated eBay prices). Now, Nintendo is promising via Facebook that domestic pre-orders will start "late this month" at "various retailers."

After insufficient supplies led to quick sellouts and high resale markups for the discontinued NES Classic Edition, Nintendo is again promising that more systems will be available for the Super NES Classic's retail tenure. "A significant amount of additional systems will be shipped to stores for launch day and throughout the balance of the calendar year," the company writes. That statement follows previous assurances from Nintendo that "we will produce significantly more units of Super NES Classic Edition than we did of NES Classic Edition." The NES Classic Edition shipped 2.3 million units.

Nintendo's announcement follows a retail fiasco last week in which Walmart mistakenly offered Super NES Classic systems for pre-order then was forced to cancel those pre-orders. "We know this is incredibly disappointing to those customers and we apologize for the mistake," the retailer said in a statement. The mistaken listing sold out within minutes late on a Friday night.
