EU Parliament Adopts Controversial ‘Upload Filter’ Proposal

In a plenary vote, the European Parliament backed an alternative to the original Article 13 proposal, but one that would still result in an indirect upload filter requirement for many Internet services. Pirate Party MEP Julia Reda regrets the outcome of the votes. However, the opposition’s fight is not over yet.

Two years ago the European Commission announced its plans to modernize EU copyright law.

While the plans initially received little mainstream attention, in recent months there has been an outpouring of opinions, warnings, and advice from both supporters and opponents.

The issue that grabbed most headlines is the “upload filter” language specified in Article 13 of the proposal.

While the word “filter” has been removed following earlier critique, the Article would require service providers that are not properly licensed to remove infringing works. In addition, they have to ensure that these works are not reuploaded anywhere on their servers, which is generally achieved by filtering.

The Legal Affairs Committee of the Parliament (JURI) adopted the proposals in June, a major setback for opponents. However, a month later the European Parliament said no to the Copyright Directive mandate. This meant that the controversial copyright reform proposal would be opened for amendments and a new vote.

Over the past several weeks, more than 100 amendments were submitted, several of which proposed an alternative to Article 13. These changes were presented in a plenary session this afternoon, where Members of European Parliament (MEPs) submitted their votes.

In a plenary vote, the majority of the MEPs voted to support the Article 13 proposal put forward by the EPP group. This is a revised version of the original, but one that would still pave the way for upload filters.

“The European Parliament endorses #uploadfilters for all but the smallest sites and apps. Anything you want to publish will need to first be approved by these filters, perfectly legal content like parodies & memes will be caught in the crosshairs,” Reda notes.

The EU Parliament also voted on proposed amendments of Article 11, after which opponents were met with disappointment. The MEPs voted in favor of a proposal by the EPP group, which keeps much of the original link tax language intact.

So what’s next?

Today’s vote is an important next step but it’s not the end of the lawmaking process. The Copyright Directive and the agreed amendments will now enter the stage of trilogue negotiations with the EU Council and Commission.

The result of these private discussions will determine the final text the European Parliament will have to vote on early next year. In most cases, the result of the trilogue negotiations is confirmed, but when that’s not the case the entire process of changes, negotiations, and a vote, starts over.

If the Copyright Directive is eventually adopted, individual Member States will have to implement it into local law, which is another hurdle that has to be passed.

Physicists at Penn State University have devised a quantum equivalent of a famous 19th-century thought experiment, capable of creating order out of an array of randomly distributed atoms. Such highly ordered blocks of atoms could one day be used as quantum gates in a quantum computer. The physicists reported their findings last week in Nature.

The second law of thermodynamics—which holds that entropy (disorder) always increases in a closed system—is one of the most unyielding laws of physics. So much so that Arthur Eddington famously proclaimed, "If your theory is found to be against the second law of thermodynamics... there is nothing for it but to collapse in deepest humiliation."

Demonic thought experiment

Around 1870, James Clerk Maxwell (father of the famous equations for electromagnetism every physics student learns in college) devised a thought experiment offering a potential loophole. He envisioned a tiny imp capable of creating order out of disorder in a closed container filled with gas. The imp accomplished this by making heat flow from a cold compartment to a hot one in apparent violation of the second law. The two compartments would be separated by a wall with a shutter covering a pinhole just large enough for a gas molecule to pass through.

The Hurricane Florence forecast has gone from bad to worse

Recent trends in the forecast models now indicate a rare—if not unprecedented track.

As of early Wednesday morning, Hurricane Florence had weakened slightly with sustained winds of 130mph, but this is of little consequence as the track forecast now shows a dangerous stalling out near the coast, or just onshore by late Thursday or Friday morning. This will exacerbate already extremely heightened concerns about inland flooding due to torrential rainfall from Florence.

Hurricanes produce three major kinds of threats: storm surge, damaging winds, and inland flooding from rainfall. Most hurricanes produce a combination of the above with varying severity, but rarely does a hurricane present all three threats at an extreme level. Florence is such a hurricane, with what the National Hurricane Center characterizes as a "life-threatening" storm surge for portions of the North and South Carolina coast, and "damaging" winds for these same coastal areas. However, probably the biggest concern with Florence is inland flooding, especially as the storm is now likely to become nearly stationary along the Carolina coast and then slowly trudge inland. Adding to these concerns is a new twist the forecast models are indicating will happen—a southwestward jog toward Georgia.
